Indiana's House Enrolled Act 1068 (2024), at IC 32-21-16.5, requires unlicensed solicitors/wholesalers to state on every solicitation that it is not from a licensed real estate professional and to disclose their name; non-disclosure is a deceptive act.
What the law requires
- Every solicitation to buy/sell a single-family home must carry "This solicitation is not from a licensed real estate professional," across all channels, plus the solicitor's legal name.
- The homeowner may rescind within two days by written notice if the disclosure was deficient.
- Investors who buy intending to take title and record the deed for their own residence or investment fall outside the "solicitor" definition.
